Empire Environmental, Inc. assists clients in disputes involving environmental issues. Occasionally,
environmental questions may arise after a transaction has been completed resulting in some form of
litigation.
A few examples of such disputes include:

Newly discovered Recognized Environmental Concerns and possible discharges
associated with them, which may or may not have been able to be detected in the due
diligence document; -
The degree of responsibility for each of several entities involved in the same or
similar business where a discharge had occurred; and, -
The age of a discharge.

An example of the latter involved a discharge of dry cleaning solvents. Empire evaluated degradation
rates and presence or absence of by-products to show that a client could not have been responsible
for a discharge that was on a site that the client and other similar businesses had occupied.

Empire Environmental, Inc. has represented clients that succeeded in obtaining a favorable
judgement in court or advantageously settled without going to trial.
